We will not give your email address or personal details to anyone, unless legally compelled |

You must not submit photos with illegal or damaging content (eg. pornographic, threatening or obscene content) |

We use the highest quality printing process to ensure that the quality of your photograph is limited only by the manner in which it is created (ie. how you took the picture and which camera you used). While every effort is made to notify you if you submit low quality images, it is ultimately your responsibility to ensure that your photos are of sufficient quality to allow for good printing results. |

If you think that your photos have been printed with substandard quality, send an email to returns@flyphoto.co.za and post the order back to us so that it can be examined by the technical experts at Orms. If they determine that we are to blame for poor quality printing, we will reimburse the postal cost and print the order and deliver it to you entirely at our cost. |

| You may NOT place any of the following material or obtain any such material using the Service: |

Any threatening, obscene, pornographic or profane material or any other material that could give rise to any civil or criminal liability |

Any material that could infringe rights of privacy or copyright without the permission of the owner of these rights and the persons who are shown in the material |

Any material sent from an anonymous or false address |

| FlyPhoto will not be liable for the content of any submission, but reserves the right not to develop and print or to delete, move or edit submissions that it, in its sole discretion, deems abusive, defamatory, obscene or in violation of copyright or trademark laws or otherwise unacceptable. |

| FlyPhoto may request confirmation of the copyright or trademark ownership from the submitter. FlyPhoto reserves the right to suspend the shipping of an order before such confirmation is received. If FlyPhoto does not receive any such confirmation or if there are continued claims of copyright or trademark infringement, FlyPhoto reserves the right to share certain account information with governmental organizations or other third parties. If you dispute any copyright or trademark infringement claims, we will share with you the contact information of any party claiming any such infringement. |

| The price of each product is displayed with the product. In the event of a sale or special offer, the discounted price is displayed |

The order can be collected at no delivery cost from the premises of Orms Prophoto Warehouse at Roeland Square, Unit 5, Canterbury Street, Cape Town, South Africa |

Delivery costs for orders delivered by courier to the specified major centres will be R45 |

Delivery costs for orders delivered by Fast Mail will be R18 |

| Vouchers |
Vouchers cannot be exchanged for cash and are not transferable or assignable
Vouchers can only be redeemed at www.flyphoto.co.za or at Orms if applicable
Vouchers can be used with on-site promotional offers
Only one voucher can be used per transaction
Vouchers cannot be redeemed with orders already placed with FlyPhoto
Promotional vouchers are issued at FlyPhoto's own discretion
Customers do not have a right to vouchers and vouchers cannot be earned
Vouchers can only be redeemed while they are valid and expiry dates cannot be extended |

| Your account |
Your account with FlyPhoto is available for your personal, non-commercial use
We need to be able to access your account to: |

remind you of your password in case you forget it; if this becomes necessary, we send an email upon your request to the address from which you opened your account |

maintain our Service to you and develop new and useful features and services |
|
to follow a court order, subpoena, complaint or lawful demand |

| FlyPhoto reserves the right to close accounts set up for unlawful purposes |

| Account fee |
| There is no fee to open a FlyPhoto account |
| |
| Cancelling the service and/or discontinuing inactive accounts |
| FlyPhoto reserves the right to cancel the Service or to discontinue accounts that have been inactive for more than 180 days. We may do so at our discretion after sending an email warning to the address you used when you set up your account. If you do not respond to the email within 10 days, your account and the images contained in it may be removed. |

| Copyrighted material and software |
| All of the information, content, software and materials we offer are protected by copyright and other applicable laws. You may not copy or distribute such material without the copyright owner's prior written consent. You may use these materials for personal, non-commercial use only, so long as you do not modify the materials or remove any copyright or other proprietary rights notices contained in the materials. |

| Third-party software |
| We may make software from third-party companies available to you. To download such software, you must first agree to the respective software licenses and/or warranties. Each software product is subject to the individual company's terms and conditions, and the agreement will be between you and the respective company. |

| This means that we do not guarantee that any software you download will be free of any contaminating or destructive code, such as viruses, worms or Trojan horses. We do not offer any warranty on any third-party software you download using Our Service. |

| Indemnification |
| You agree to indemnify, defend and hold us harmless, as well as our officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Service from and against all losses, expenses, damages and costs, resulting from any violation of these Terms or any activity related to your account by you or any other person accessing the Service using your account. |

| Limitation of liability |
| FLYPHOTO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF FLYPHOTO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE USE OR THE INABILITY TO USE FLYPHOTO'S SITE OR SERVICES, FROM ANY CHANGES TO THIS SITE OR ITS SERVICES, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA. |

| Domicilium |
| FlyPhoto chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 55 Hastings Street, Tamboerskloof, Cape Town, 8001. The user's domicilium citandi et executandi shall be as reflected in the order details. |

| Miscellaneous |
| All items purchased through FlyPhoto are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to our carrier. |

| After collection/delivery of the printed photos, FlyPhoto is not responsible to retain any of the material submitted and may delete same. |
| |
| If any part of this Agreement is held to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision most closely matching the intent of the original provision and the remainder of the Terms will continue in effect. |
| |
| These Terms constitute the entire agreement between you and us with respect to this Service, and supersede all other communications, written or oral, with regard to the Service. |
